Oath is upon the accused

عَنِ ابْنِ أَبِي مُلَيْكَةَ أَنَّ امْرَأَتَيْنِ كَانَتَا تَخْرِزَانِ فِي بَيْتٍ ـ أَوْ فِي الْحُجْرَةِ ـ فَخَرَجَتْ إِحْدَاهُمَا وَقَدْ أُنْفِذَ بِإِشْفًى فِي كَفِّهَا، فَادَّعَتْ عَلَى الأُخْرَى، فَرُفِعَ إِلَى ابْنِ عَبَّاسٍ، فَقَالَ ابْنُ عَبَّاسٍ قَالَ رَسُولُ اللَّهِ صَلَّى اللّٰهُ عَلَيْهِ وَسَلَّم: لَوْ يُعْطَى النَّاسُ بِدَعْوَاهُمْ لَذَهَبَ دِمَاءُ قَوْمٍ وَأَمْوَالُهُمْ.‏ ذَكِّرُوهَا بِاللّٰهِ وَاقْرَءُوا عَلَيْهَا ‏{‏اِنَّ الَّذِیۡنَ یَشۡتَرُوۡنَ بِعَہۡدِ اللّٰہِ}‏‏.‏ فَذَكَّرُوهَا فَاعْتَرَفَتْ، فَقَالَ ابْنُ عَبَّاسٍ قَالَ النَّبِيُّ صَلَّى اللّٰهُ عَلَيْهِ وَسَلَّم:الْيَمِينُ عَلَى الْمُدَّعَى عَلَيْهِ‏‏.‏

It is narrated by Ibn Abi Mulaika, “Two women were stitching shoes in a house – or in a chamber. Then one of them came out with an awl pierced into her hand and accused the other. The case was brought to Ibn Abbasra, who said:

“‘Allah’s Messengersa said, ‘If people were to be given [merely] based on their claims, the life and property of the people would be lost.’ Remind her [i.e., the defendant] by invoking Allah and recite to her:

اِنَّ الَّذِیۡنَ یَشۡتَرُوۡنَ بِعَہۡدِ اللّٰہِ

“‘[‘(As for) those who take a paltry price in exchange for (their) covenant with Allah…’ (Surah Al-e-‘Imran, 3:78)]’“So they reminded her and she confessed. Ibn Abbasra then said, ‘The Prophetsa said, ‘The oath is to be taken by the defendant [in the absence of any proof against them]’.”
